These may include restrictions on disclosing nonpublic personal information, required initial and subsequent privacy notices, consumer opt-out rights concerning certain third-party disclosures, and obligations relating to the security and confidentiality of financial information.

We will provide any separate GLBA financial privacy notice and legally required opt-out mechanism when applicable.

Nothing in this Privacy Policy expands our authority to share nonpublic personal financial information beyond what applicable law permits.

7. Information Security

MAP maintains administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, misuse, alteration, disclosure, or destruction.

Our security program is intended to address risks associated with the collection and processing of sensitive borrower and property information.

Security controls are selected based on applicable legal requirements, operational needs, and reasonable assessments of risk.

No method of transmitting or storing information is completely secure. We therefore cannot guarantee absolute security.

8. Data Retention and Disposal

We retain personal information only for as long as reasonably necessary to fulfill the purposes described in this Policy or to meet applicable legal, regulatory, contractual, audit, dispute-resolution, and recordkeeping obligations.

Applicable retention periods may differ based on the nature of a transaction, the laws governing it, and the type of information involved.

When information is no longer required, we take reasonable steps to delete, destroy, de-identify, or otherwise securely dispose of it, subject to applicable retention obligations.

We may preserve information in connection with litigation, investigations, legal holds, or regulatory requirements.

Where required, we will obtain consent before initiating covered communications.

Recipients may withdraw consent to marketing text messages by replying STOP, where the messaging system supports that function, or by contacting us.

Withdrawal of marketing consent does not necessarily prevent legally permitted operational or transactional communications.

We do not treat submission of a website inquiry as blanket authorization for all forms of marketing communication.

11. Consumer Privacy Rights

Depending on residency, the type of personal information involved, applicable legal exemptions, and other legal requirements, individuals may have rights to:

  • Confirm whether we process their personal information.

  • Request access to personal information.

  • Exercise applicable privacy rights without unlawful discrimination or retaliation.

These rights are not absolute. Certain information may be exempt, including information regulated under GLBA, information required to complete a transaction, and records that must be retained under law.

MAP will not discriminate unlawfully against individuals who exercise their privacy rights.

12. State-Specific Privacy Protections

MAP recognizes that privacy rights vary by state and may also be affected by local ordinances, sector-specific laws, and applicable federal law.

We intend to administer applicable privacy requests in accordance with the requirements of the state law governing the information and individual involved.

California

Eligible California residents may exercise applicable rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act, including rights to know, access, correct, delete, and obtain information about certain personal information practices, as well as applicable opt-out and sensitive-information rights.

California financial information and entities may qualify for statutory exemptions. Such exemptions will be applied only where legally supported.

Where California law requires a separate notice at collection, additional disclosures, or a specific opt-out mechanism, MAP will provide those requirements.

Virginia

Eligible Virginia residents may have rights under the Virginia Consumer Data Protection Act, including access, correction, deletion, data portability, and applicable opt-out rights.

Where the Act applies to MAP and the information concerned, we will provide a process for submitting requests and appealing eligible denials.

Other States

Residents of Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Delaware, New Hampshire, Nebraska, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky, Rhode Island, and other jurisdictions with applicable privacy legislation may exercise the rights provided by the laws governing their information.

State-specific requirements concerning consent, sensitive information, opt-out signals, profiling, appeals, and request deadlines will apply where legally required.

Where a state's privacy law does not apply because of business-size thresholds, entity exemptions, regulated-data exemptions, or other statutory limitations, MAP will comply with all other applicable privacy and consumer protection laws.

Other State and Local Requirements

MAP will also comply with applicable state and local laws concerning information security, data breach notifications, consumer financial information, identity theft protection, communications, and records management.

Nothing in this Policy is intended to waive rights or protections granted by applicable law.

13. California Collection and Disclosure Categories

For purposes of applicable California privacy requirements, the categories of personal information that MAP may collect include identifiers; customer and financial records; protected classification information when voluntarily submitted and relevant; commercial and transaction information; internet or electronic network activity; professional or employment information; sensitive personal information; and inferences derived from information for legitimate case processing.

The specific categories collected depend on the interaction, requested services, and documentation submitted.

Information may be disclosed to service providers, transaction participants, government authorities, and other authorized recipients as described in this Policy.

Where California law requires disclosure of the categories actually collected, disclosed, sold, or shared during the preceding 12 months, MAP will provide an accurate account based on its records and practices.

We will provide any required supplemental California notices concerning retention, sensitive information, and advertising or cross-context sharing.

14. Processing of Sensitive Information

Financial account credentials, Social Security numbers, identification documents, loan information, and hardship materials may require heightened protection.

We use such information for legitimate and authorized purposes connected with mortgage assistance, transaction administration, legal obligations, or information security.

We will not use sensitive information for unrelated purposes where applicable law prohibits such use or requires consent that has not been obtained.

Where an individual submits medical or health information to support a financial hardship request, we will treat that information as sensitive and limit its use to relevant authorized purposes.

Our website and communications may contain links to third-party websites, mortgage servicing portals, government resources, electronic signature platforms, and other external services.

Those third parties may maintain independent privacy practices.

This Policy does not govern information collected by third parties acting independently of MAP.

We encourage individuals to review the privacy policies of those services before submitting information.

17. Data Breaches and Security Incidents

If MAP identifies a security incident involving personal information, we will investigate the incident, take appropriate containment and remediation measures, assess legal notification obligations, and provide required notifications to affected individuals, regulators, or other parties.

Notification obligations and deadlines will be determined under the applicable federal and state requirements, including the nature of the affected information and the circumstances of the incident.

We maintain procedures intended to support timely investigation, escalation, and response.

18. Authorized Representatives, Estate Matters, and Deceased Borrowers

Mortgage assistance transactions may involve powers of attorney, estates, trusts, heirs, executors, administrators, guardians, and other legal representatives.

MAP may require documentation establishing the individual's legal authority before disclosing borrower, mortgage, property, or estate-related information.

Such documentation may include death certificates, letters testamentary, letters of administration, powers of attorney, court orders, or other legally sufficient records.

Disclosure of information concerning deceased borrowers, surviving spouses, heirs, and successors in interest will be handled in accordance with applicable law, the relevant authorization, and mortgage servicing requirements.
